These Terms of Use (“Terms”) govern your use of the BinoView mobile application (“BinoView”, the “App”), provided by HGEAR BV (“HGEAR”, “we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
BinoView is a camera application that helps you capture photos and videos through binoculars and similar optics, with framing, zoom, and stabilization tools.
Subject to these Terms and to Apple’s Licensed Application End User Licence Agreement (“Apple’s Standard EULA”, available at apple.com/legal/internet-services/itunes/dev/stdeula), HGEAR grants you a personal, non-transferable, non-exclusive licence to use BinoView on Apple devices that you own or control. These Terms supplement Apple’s Standard EULA; in the event of a conflict, Apple’s Standard EULA applies as a minimum.
BinoView offers an optional auto-renewing subscription that unlocks premium features such as optical lens switching and live stabilization.
You agree to use BinoView lawfully and responsibly. You are solely responsible for the content you capture and for complying with all applicable laws — including privacy, surveillance, and property laws — when recording. Do not use BinoView to infringe the rights of others.
Take care when using a mobile device together with binoculars or other optics. Remain aware of your surroundings. HGEAR is not responsible for any injury, loss, or damage resulting from your use of the App.
BinoView, including its software, design, and trademarks, is owned by HGEAR or its licensors and is protected by law. These Terms do not grant you any rights in HGEAR’s intellectual property except the limited licence described above.
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. HGEAR does not warrant that the App will be uninterrupted, error-free, or compatible with every device.
To the maximum extent permitted by applicable law, HGEAR shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the App. Nothing in these Terms limits liability that cannot be limited under Belgian law, including your mandatory rights as a consumer.
These Terms are concluded between you and HGEAR only, and not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
These Terms are governed by the laws of Belgium. Mandatory consumer-protection rights of your country of residence remain unaffected. Disputes are subject to the competent courts of Belgium, without prejudice to any mandatory consumer jurisdiction rules.
We may update these Terms from time to time. The “Effective date” above shows when they were last revised. Continued use of the App after changes take effect constitutes acceptance.

Deze gebruiksvoorwaarden (“Voorwaarden”) regelen uw gebruik van de mobiele applicatie BinoView (“BinoView”, de “App”), aangeboden door HGEAR BV (“HGEAR”, “wij”, “ons”). Door de App te downloaden of te gebruiken, gaat u akkoord met deze Voorwaarden. Gaat u niet akkoord, gebruik de App dan niet.
BinoView is een cameratoepassing waarmee u foto’s en video’s kunt maken door een verrekijker en soortgelijke optiek, met hulpmiddelen voor kadrering, zoom en stabilisatie.
Onder deze Voorwaarden en de Licensed Application End User Licence Agreement van Apple (“Standaard-EULA van Apple”, beschikbaar op apple.com/legal/internet-services/itunes/dev/stdeula), verleent HGEAR u een persoonlijke, niet-overdraagbare, niet-exclusieve licentie om BinoView te gebruiken op Apple-toestellen die u bezit of beheert. Deze Voorwaarden vormen een aanvulling op de Standaard-EULA van Apple; bij tegenstrijdigheid geldt de Standaard-EULA van Apple als minimum.
BinoView biedt een optioneel automatisch verlengend abonnement dat premiumfuncties ontgrendelt, zoals het schakelen tussen optische lenzen en live stabilisatie.
U stemt ermee in BinoView rechtmatig en verantwoord te gebruiken. U bent als enige verantwoordelijk voor de inhoud die u vastlegt en voor de naleving van alle toepasselijke wetten — waaronder wetgeving inzake privacy, bewaking en eigendom — bij het opnemen. Gebruik BinoView niet om de rechten van anderen te schenden.
Wees voorzichtig bij het gebruik van een mobiel toestel in combinatie met een verrekijker of andere optiek. Blijf alert op uw omgeving. HGEAR is niet verantwoordelijk voor letsel, verlies of schade die voortvloeit uit uw gebruik van de App.
BinoView, met inbegrip van de software, het ontwerp en de handelsmerken, is eigendom van HGEAR of haar licentiegevers en wordt beschermd door de wet. Deze Voorwaarden verlenen u geen rechten op de intellectuele eigendom van HGEAR, behalve de hierboven beschreven beperkte licentie.
De App wordt geleverd “zoals ze is” en “zoals beschikbaar”, zonder enige garantie, uitdrukkelijk of impliciet, voor zover maximaal toegestaan door de wet. HGEAR garandeert niet dat de App ononderbroken, foutloos of compatibel met elk toestel zal zijn.
Voor zover maximaal toegestaan door de toepasselijke wetgeving is HGEAR niet aansprakelijk voor enige indirecte, incidentele of gevolgschade die voortvloeit uit of verband houdt met uw gebruik van de App. Niets in deze Voorwaarden beperkt de aansprakelijkheid die naar Belgisch recht niet kan worden beperkt, met inbegrip van uw dwingende rechten als consument.
Deze Voorwaarden worden uitsluitend tussen u en HGEAR gesloten, en niet met Apple. Apple is niet verantwoordelijk voor de App of de inhoud ervan. Apple en haar dochterondernemingen zijn derde-begunstigden van deze Voorwaarden en hebben, na uw aanvaarding, het recht deze tegen u af te dwingen.
Op deze Voorwaarden is het Belgische recht van toepassing. Dwingende consumentenbeschermingsrechten van uw land van verblijf blijven onverlet. Geschillen vallen onder de bevoegde rechtbanken van België, onverminderd eventuele dwingende bevoegdheidsregels voor consumenten.
Wij kunnen deze Voorwaarden van tijd tot tijd bijwerken. De “Ingangsdatum” hierboven geeft aan wanneer ze het laatst zijn herzien. Voortgezet gebruik van de App nadat wijzigingen van kracht worden, geldt als aanvaarding.
